Terms & Conditions

1.  DEFINITIONS

 

Account Owner refers to you, the individual, company, trust, or other legal entity that holds rightful ownership of the unclaimed funds.  

Account Owner’s Agent refers to any authorised representative acting on the Account Owner's behalf to lodge a claim using My Refund Finder's services.  

Authority To Investigate, Act & Release herein referred to as the 'Agreement' - can also be referred to as Letter of Authority or Authority to Release.  This Agreement document, in its entirety, (including this Terms & Conditions page), outlines the terms, conditions, and authorisations governing our services.  

My Refund Finder refers to its owners, partners, employees, and agents, collectively referred to as 'Us', 'We', or 'Our'.  These terms apply to all services provided by My Refund Finder, whether delivered in person, over the phone, via our website - www.my refundfinder.com - or through any other communication channels.  

Refunded Money refers to any funds identified as lost, unclaimed, or owed, including but not limited to shares, bonds, and funds from deceased estates, which are located, claimed, and successfully refunded through My Refund Finder's services.  

2. OUR ROLES & RESPONSIBILITIES


My Refund Finder agrees to act as the authorised representative for the Account Owner in identifying, verifying, and facilitating the recovery of lost and unclaimed funds, in accordance with the instructions provided by the Account Owner or their designated, authorised agent - Account Owner's Agent.

3. PERFORMANCE, LIABILITY & ACCURACY


My Refund Finder will use due diligence, skill, and care to recover the owed funds as quickly as possible.  However, we are not liable for any delays caused by third parties or circumstances beyond our control.  
 

We cannot guarantee the accuracy or completeness of information provided by third parties.  Our details regarding potentially owed monies are based on the information supplied by relevant government agencies.  

The source of the lost funds will only be disclosed upon receipt of a fully executed (signed) Agreement.  Once this information has been provided, the Account Owner or the Account Owner's Agent agrees not to bypass My Refund Finder by pursuing the holder of the funds directly.  If the Account Owner or Account Owner's Agent attempts to recovers the funds directly once the Agreement been signed, and either hinders the process for My Refund Finder, or receives the recovered funds directly, My Refund Finder will issue an invoice for services rendered at the standard rate of 20% of the recovered funds..​

4. ACCOUNT OWNER'S AGENTS WARRANTIES


If an individual is acting as the legal authority in the capacity as a company director, executor, attorney, or any other authorised representative on behalf of the Account Owner, they will be referred to as the Account Owner’s Agent.  They confirm that they have the necessary capacity to enter into this Agreement and authorise My Refund Finder to recover lost and unclaimed funds on behalf of the Account Owner.

 

The Account Owner's Agent further confirms that, by signing the Agreement, they have reviewed, understood, and accepted the terms from the My Refunder Finder website - Terms & Conditions page, and are fully aware of their obligations, and agree to comply with them in their entirety.​

5. AUTHORITY TO ACT


The Agreement document represents the complete understanding between the parties.  By signing the Agreement, both parties acknowledge and accept all terms and conditions outlined within the document as well as the Terms & Conditions page from this site.

The Account Owner or the Account Owner's Agent agree that a fully executed Agreement serves as an irrevocable instruction for My Refund Finder to investigate and recover lost funds on their behalf.

Once the funds are successfully recovered, My Refund Finder is authorised to deduct its processing fee of 20% (unless stated otherwise) from the total amount.  The remaining balance will then be issued by trust account cheque, which will be payable within 14 days once the total amount of all funds has been recovered & cleared.

6. INFORMATION, PROVISION & PRIVACY


The Account Owner or the Account Owner's Agent agrees to provide accurate and timely information.  Any failure to do so may lead to delays or an unsuccessful claim. My Refund Finder will use the provided information exclusively for the purpose of recovering the refund and will manage it in accordance with Australian privacy laws and our Privacy Policy.

7. FEES

 

Our standard processing fee is 20% of the total refunded amount - unless otherwise stated.  For charities we will only charge a 10% processing fee as our way of supporting these people oriented organisations.

8. LIMITATION OF LIABILITIES

By using our services, you acknowledge that it is at your own risk.  We exclude all implied warranties and conditions, except those mandated by law.  We are not liable for any delays resulting from your failure to provide required documentation; from processing times set by government agencies or for amounts that are not recovered.

9. DISPUTE RESOLUTION

If a dispute arises concerning this agreement or our services, both parties agree to attempt informal dispute resolution methods, such as mediation, before pursuing formal legal action.  This agreement will be governed by Australian law, and both parties consent to the non-exclusive jurisdiction of the courts in Australia.

10. PRIVACY POLICY

The privacy of the Account Owner is a priority for the Business.  Any information provided by the Account Owner or the Account Owner's Agent is used exclusively for the purpose of recovering the Account Owner’s lost money.  All investigators employed by the My Refund finder are dedicated to delivering high-quality recovery services in a secure and confidential environment.


This includes personal or company information that can identify the Account Owner, such as name, email address, and other contact details, as well as any additional information required by the Holding Authority to facilitate the recovery process.  It is essential that this information is accurate and up-to-date to ensure effective communication and service delivery.


The Business will retain the Account Owner’s personal information only as long as necessary to provide the recovery services, unless otherwise required by law.
